Acceptance of Terms

By accessing or using the website at sanbernardinosunroomcontractor.com, by submitting a contact or estimate request form, or by entering into a service agreement with San Bernardino Sunrooms & Patios ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. Description of Services

San Bernardino Sunrooms & Patios provides residential sunroom construction, sunroom additions, patio enclosures, screen room installation, solarium installation, and related outdoor living improvement services in San Bernardino, CA and surrounding communities.

All services are subject to a written project agreement signed by both parties before work begins. The scope of work, materials, timeline, and pricing set out in that agreement govern the project. These Terms and Conditions apply alongside and in addition to any such written agreement.

Estimates and Pricing

Written estimates provided by San Bernardino Sunrooms & Patios are based on information available at the time of the on-site visit and are valid for 30 days from the date of issue unless otherwise stated in the estimate document. Estimates are not binding contracts.

A signed written agreement is required before any work begins. The price stated in the signed agreement is the agreed contract price. Changes to the scope of work requested by the customer after the agreement is signed may result in additional charges, which will be documented in a written change order before the additional work proceeds.

We are not responsible for price changes resulting from material cost increases, unforeseen site conditions, permit requirements not identified during the initial estimate, or changes in local building code requirements after an estimate is issued.

Scheduling and Cancellation

Project start dates are subject to permit approval, material availability, and current scheduling. We will communicate estimated timelines to customers and provide updates if those timelines change.

Customers who wish to cancel a project after signing an agreement should notify us in writing as soon as possible. Cancellation terms, including any applicable cancellation fees or refund of deposits, are set out in the signed project agreement.

We reserve the right to reschedule work due to weather conditions, permit delays, supplier issues, or other circumstances outside our control. We will provide reasonable notice of any rescheduling.

Payment Terms

Payment terms are stated in the signed project agreement. A deposit is typically required before work begins, with the remaining balance due at project completion or according to a milestone schedule set out in the agreement.

Invoices not paid within the time period stated in the agreement may be subject to a late fee as described in the agreement. We reserve the right to suspend or halt work on any project where payment obligations are not met.

Accepted payment methods will be communicated to you at the time of contracting. Personal checks, cashier checks, and electronic payments may be accepted depending on project size and payment schedule.

Permits and Compliance

San Bernardino Sunrooms & Patios will obtain required building permits on behalf of the customer for projects that require them under applicable local and state regulations. Permit fees are typically included in or added to the project cost, as specified in the written agreement.

The customer is responsible for disclosing any known property restrictions, easements, homeowners association (HOA) rules, or deed restrictions that may affect the project. Delays or additional costs resulting from HOA or other third-party approval requirements not disclosed at the time of contracting are the responsibility of the customer.

Warranty Disclaimers

We stand behind our workmanship. Any workmanship warranty provided by San Bernardino Sunrooms & Patios will be stated in writing in the signed project agreement.

Materials and products installed as part of a project may carry manufacturer warranties. We will communicate available manufacturer warranties at the time of project completion, but we make no independent warranty beyond what is stated in the signed agreement.

Our website is provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be error-free, uninterrupted, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, San Bernardino Sunrooms & Patios shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services, this website, or these terms - even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of our services shall not exceed the amount paid by you to us for the specific project giving rise to the claim.

Dispute Resolution

We prefer to resolve disputes directly and informally. If you have a concern about your project or our services, please contact us first so we have the opportunity to address it.

If an informal resolution is not reached, disputes arising from our services or these terms will be resolved through binding arbitration in San Bernardino, CA, unless both parties agree otherwise in writing. The arbitration will be conducted under the rules of a mutually agreed arbitration service.

Nothing in these terms prevents either party from seeking emergency injunctive relief from a court where necessary to prevent irreparable harm.

Governing Law

These Terms and Conditions and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in a court of competent jurisdiction in San Bernardino, CA.

Modifications to These Terms
